Asset Fund

The patrimonial fund is a bond that is created by one of the two spouses on certain assets in order to allocate them solely to the needs of the family.
The patrimonial fund was introduced with the family law reform of 1975 and replaced the family patrimony instrument.
With the patrimonial fund the transfer of ownership or possession of the assets in favor of third parties is not implemented, but the aforementioned assets are bound to satisfy the needs of the family.
The ownership of the assets forming part of the family patrimony, unless the deed of incorporation of the same establishes otherwise, belongs to both spouses.
