The crime is that human fact prohibited by the legal system for which a sanction is envisaged among those indicated by article 17 of the Criminal Code.
In order for the crime to exist, the fundamental elements must exist, such as:
- typical fact: the human conduct that generated the event;
- guilt;
- unlawful: contrast between the rule and the fact.
For those who commit a crime, the law provides for different types of sanctions:
- crimes: life sentence, imprisonment and fine;
- contraventions: arrest and fine.
