The Italian Civil Code does not provide a specific definition of the institution of the Condominio, but by including the rules concerning it in Book III (of properties) to Chapter II of Title VII (of communion) it is easy to understand that the condominium is a particular form of communion in which parts of exclusive property and parts of common property coexist.
With the law 11 December 2012 n. 220 ("Changes to the condominium regulations in buildings") the matter concerning the condominium has been significantly changed through the revision of some of the articles (such as, for example, art. 1117 and art. 1129 on the figure of the administrator) and the addition of new ones (art. 1117 bis to quater; art. 1122 bis and ter; art. 1130 bis).
Furthermore, shortly after the reform, with the Destination Italy Decree (D.L. 145/2013), other provisions were introduced to regulate the condominium matter.
